The draft Environment Impact Assessment (EIA) 2020 has garnered a host of criticism from various parts of the country. Legitimate issues regarding clearance processes and dilution of public consultation, amongst others, have arguably weakened the essence and functioning of the EIA in India. Organizations and individuals from across the country have taken to online spaces to display their displeasure towards the draft during this pandemic. The current draft seems to view the EIA as an unnecessary hurdle in the path towards development. Yet, the history of this legislation tells us that it is a responsibility and obligation, not just for the conservation of flora and fauna, but also to local communities who will be affected. While it is evident that the Ministry of Environment, Forest and Climate Change (MoEFCC) is in a tough spot, it is essential that citizens enact their right and responsibility to make their voices heard. However, the recent blocking of websites belonging to three environment activism groups has indicated a strong sense of disapproval from the Government’s side. In any case, with the last date for public responses set for 11th August 2020, we examine the importance of the EIA, its functioning and the issues with the latest draft.
